1st Professional Forum

Theme: Managing Tax Controversy and Disputes in a VUCA World

Preamble

Modern Business environment has been described as Volatile, Uncertain, Complex and Ambiguous (VUCA).  This complexity in business environment extends to tax compliance, increasing the risk of innocent omissions and the temptation to use injudicious means to minimize tax obligations.  Tax authorities on the other hand are under pressure to increase revenues and address budget gaps.  To meet the revenue targets, the government is employing more sophisticated technology, improving its administrative procedures and coming up foolproof tax laws.

Under the circumstances, the tax practitioner is duty bound to serve the clients best interests while helping his government meet its revenue targets. Reconciling the varying tax interests calls the tax practitioner to employ multi-disciplinary measures; first a proactive role eliminating all tax risks and controversies, secondly finding an amicable solution should any dispute arise.

During this forum, we shall explore practical ways of mitigating tax disputes, the dispute resolution mechanisms under the law and the respective roles of the tax payer, tax practitioner and the tax authority.

Learning outcomes

(i) To identify possible ways of preventing tax dispute.

(ii) To evaluate dispute handling mechanism under the Alternative Dispute Resolution (ADR) Framework.

1.0 Continuous Professional Development Units (CPD Units)

5.0 National Industrial Training Authority (NITA) Reimbursement

The Institute is registered as a trainer with National Industrial Training Authority. The Institute’s registration number is DIT/TRN/47. Participants who are registered levy contributors should apply to NITA for reimbursement of their fees. Please note that this is applicable for Kenyan citizens only and subject to NITA regulations. Remember that to qualify you should apply to NITA for approval prior to the date of the conference. Further details can be obtained from their website (www.nita.go.ke).
