Discussions on Alternative Dispute Resolution(ADR) mechanism among members of the accounting profession are long overdue. Even though ADR has been used in the conduct of business since ages, its formal recognition in laws has called for special attention to it by business leaders and professionals. The requirement in most cases that ADR be incorporated in contracts for it to be an option when dispute arises makes this discussion and awareness even more urgent.
The Constitution of Kenya 2010 in Article 159 empowered courts and tribunals to promote and use alternative forms of dispute resolution. These are listed in the constitution as reconciliation, mediation, arbitration and traditional dispute resolution mechanisms. We look forward to creating awareness about the difference in these mechanisms, their advantages and technicalities. We will also discuss the requirements for their application, the legal frame work in Kenya for the use of ADR, use of ADR in commercial transactions locally and globally, in private business and in government trade transactions. This forum will also create awareness among professionals on the opportunities therein in ADR.

4.0 National Industrial Training Authority (NITA) Reimbursement
The Institute is registered as a trainer with National Industrial Training Authority. The Institute’s registration number is DIT/TRN/47. Participants who are registered levy contributors should apply to NITA for reimbursement of their fees. Please note that this is applicable for Kenyan citizens only and subject to NITA regulations.
