OVERVIEW

Reliance on taxes to fund current and development expenditure continues to be the focus on many African governments including Kenya. International taxes also contribute greatly to this objective of the government. International taxation refers to the determination of tax on a person or business subject to the tax laws of different countries, or the international aspects of an individual country’s tax laws.

About 70% of the taxes are collected from domestic resources. Domestic resource mobilization is therefore key for sustainable development and the focus is now on international taxation and implementing strategies to enhance compliance with transfer pricing regulations, preventing treaty abuse and policy redesign.
Consequently, there has been increased reliance on international taxes compared to the use of other taxes and this has played a key role in tax reforms put in place by many governments. In Kenya, we have witnessed the overhaul of the Value Added Tax in 2013, the introduction of Excise Act, 2015 and the ongoing processes of overhauling the current Income Tax Act. All these efforts are aimed at widening the tax base as well as promoting tax compliance. The reforms are further aimed at aligning domestic tax regimes with international tax practice where possible.
While taking into consideration the changes in business models, the governments often make amendments to the existing tax legislations. The rapid growth in the digital economy has also triggered many changes in the taxation regime globally. For example, in Kenya, we have witnessed introduction of digital service tax and Value Added Tax on digital services.
The Workshop seeks to respond to and provide ways of tax planning on aspects of international taxes through a detailed analysis of the existing legislations while leveraging on relevant case laws and studies.

Specifically, the sessions will cover the following international tax related areas:
1. Introduction to International taxes and emerging issues
o Introduction to international taxes
o Emerging issues affecting international taxes
o Expected trends in international trade and related taxes
2. Double taxation and related treaties and conventions
3. Customs and international trade
o Introduction to customs and EACCMA
o Custom documentation and procedure requirements (compliance requirements).
o Customs management in the wake of Africa Continental free trade area and other emerging issues
4. Base Erosion and Profit Shifting (BEPS) considerations in Transfer Pricing
5. Excise tax – “sin tax” and emerging issues
o Introduction and history to excise tax – is excise tax a “sin tax”?
o Provisions of Excise Act
o Emerging issues on excise tax
6. Corporate income tax and the current developments
o Introduction & history of income tax in Kenya and link to international taxes
o Digital service tax and online international taxes
7. Withholding tax developments
o Understanding withholding taxes and income tax Act
o Compliance requirement for withholding tax
o Withholding tax and Double tax agreements
o Pros and cons of withholding tax
8. Personal and expatriates tax
o Introduction and history of personal taxes
o Taxation of cash and non-cash benefits
o Taxation of terminal dues
o Statutory deductions and tax planning
9. Panel discussion – considerations in international taxes and the link to accelerated economic growth and development
