OVERVIEW
Taxation remains a key cornerstone of national development and public finance agenda in many jurisdictions across the globe today. In recent years, Kenya and other economies in the Eastern African region as well as at global level have witnessed rapid changes in the tax landscape. These changes have been brought by technological advancements, changing regulatory frameworks, regional integration, and global tax reforms such as the OECD BEPS and the digital economy tax. These changes are even expected to be more severe and widespread with the emerging global trade wars and geopolitical realignments engendered by the US President Donald Trump’s increment of tariffs for countries across the world exporting goods and services to the US.
Coming back home, Kenya has over the recent past witnessed developments in the tax laws and policy impacting significantly on the operating tax environment for individual taxpayers, local firms and businesses. The rapidly growing public recurrent expenditure on wages and salaries and servicing the ballooning public debt has prompted the Kenyan Government to introduce new tax measures to meet the increasing demands. This trend is likely to continue considering the public debt appetite and obligations is expected to grow and expand in the future particularly to finance infrastructural development projects in the country.
Another key development worth considering is the emerging digital economy. The emerging digital economy has brought with it tax implication for firms and persons conducting their day-to-day business operations in the digital platforms. As a result, a new tax category has emerged -digital service tax. It is therefore imperative to not only create awareness of the emerging tax areas but also deepen the skills and knowledge of practicalities of computing and filing returns for the same amongst accounting professionals.
The globalization forces have led to firms and business ventures scaling up to regional, continental and even global levels. With growth and expansion of business beyond the territorial boundaries of the country of origin, the issue of transfer pricing and cross-border taxation comes in. Accounting professionals are at the forefront either in providing tax return services or advisory for many of the firms and business scaling up their businesses to regional or international sphere.
Furthermore, there is an increased demand for tax and accounting professionals to conduct themselves in their personal and business relationships in an ethically sound and professional manner. In addition, tax professionals are often faced with tax related disputes between their clients and the Kenya Revenue Authority. It is therefore imperative, that the professionals are capacity built on tax dispute resolution and litigation to facilitate delivery of quality services to their clients and help them manage their tax liabilities and obligations.
Sustainability reporting and assurance is now emerging as a key ingredient for sustainable value creation for shareholders and stakeholders a like. The tax implications of adopting and implementing sustainability standards both as a practitioner and at firm level is an important imperative going forward into the future. Environment, Social and Governance (ESG) taxation is therefore critical in fostering enhanced tax compliance and engendering economic transformation.
Last but not the least, the nexus between taxation and Sustainable Development Goals (SDGs) is critical in establishing and assessing how tax regimes of economies either incentivizes or disincentivizes the attainment of the global goals anchored on the sustainable development goals framework.
It is therefore imperative that with the growing complexity of tax compliance and administration, professionals are appropriately equipped to understand and the evolving tax measures and how they affect businesses and individuals. The Annual Tax Convention, now in its 13th year, provides a unique platform for knowledge exchange, capacity building, and strategic dialogue on pertinent tax measures. The five-day CPD event is designed to equip tax and accounting professionals with practical knowledge and up-to-date insights on relevant tax laws and measures, tax compliance requirements, and emerging trends.
